Brewster v. S.D. Warren/Sappi, N.A.- where the ex-spouse of decedent employee was dependent at the time of injury in 1985 but had been divorced for 23 years at the time of death in 2020, the Law Court affirmed the Appellate Division upholding the ALJ’s award of death benefits under former 39 M.R.S. sec. 58. Dependency is only required at the time of injury and not at the time of death. The Court suggests the same result is obtained under the current death benefit statute 39-A M.R.S. sec. 215.
